Suspension and termination of payment of the allowance
The work ability allowance is suspended for 10 (ten) days if a recipient of the work ability allowance with partial work ability who has been registered as unemployed for the first time without valid reason
- does not participate in the counselling at the agreed time or in the agreed manner,
- does not fulfil the programme or
- refuses a suitable job.
The work ability allowance is suspended for 30 (thirty) days if a recipient of the work ability allowance who has been registered as unemployed does not comply with the activity requirements for the second time without valid reason. Upon re-registering as unemployed, the right to the allowance will start once the period of suspension has ended. Payment of the work ability allowance will only be suspended if the person does not meet another activity requirement at the same time. For example, if a recipient of the work ability allowance is raising a child under the age of 3 (three) at the same time as being registered as unemployed, the allowance will not be suspended.
Suspension due to missing data
If the recipient's work ability allowance paid as home payment or bank transfer is returned to the Estonian Unemployment Insurance Fund for two consecutive months, payment of work ability allowance is suspended from the third month.
If the recipient of the work ability allowance fails to provide the Estonian Unemployment Insurance Fund with information on income from abroad for 2 (two) consecutive months, payments of the work ability allowance are suspended starting from the month for which the information required for payment of the allowance is missing.
Termination
Payment of the work ability allowance is terminated if the recipient of the work ability allowance with partial work ability
- does not fulfil activity requirements (doesn't work, doesn't study, etc.) or
- does not comply with the activity requirements for unemployment for the third time without valid reason and their unemployment status is cancelled.
Work ability allowance is not terminated if the person with partial work ability complies again with the same or another activity requirement no later than 14 calendar days after the end of one activity requirement. If the recipient of work ability allowance had unemployment status as an active condition and the new condition is also unemployment status, and the person did not meet any of the other active requirements in between the two periods of having unemployment status, the payment of work ability allowance to the person will be terminated on the date of termination of the first unemployment status, regardless of the fact that the person re-registered as unemployed within 14 calendar days.
Example: The recipient of the allowance with partial work ability will graduate from their studies on 20 June 2020. They start working or register as unemployed on 2 July 2020 and therefore continue to receive the work ability allowance. Likewise, the work ability allowance will continue to be paid if the recipient with partial work ability returns to work or registers as unemployed within 14 days of the end of the employment contract.
If the recipient with partial work ability fulfils more than one activity condition at once (e.g. working and raising a child under the age of 3 (three)), then, when one activity requirement expires, the work ability allowance will continue to be paid on the basis of the other activity condition.
Furthermore, payment of the work ability allowance is terminated after 12 (twelve) calendar months if the recipient has not submitted a new form of payment or provided proof of their income from abroad for 12 (twelve) consecutive calendar months after the refund of the allowance to the Unemployment Insurance Fund.
